A Study on Risk Management in Banking Industry Essay

Risk management is relatively new and emerging practice as far as Indian banks are concerned and has been proved that it’s a mirror of efficient corporate governance of a financial institution. Globalization and significant competition between foreign and domestic banks, survival and optimizing returns are very crucial for banks and financial institutions. However, selecting the efficient customer and providing innovative and value added financial products and services are another paramount factors. In a volatile and dynamic market place for achieving sustainable business growth and shareholder’s value, it is essential to develop a link between risks and rewards of all products and services of the bank. Hence, the banks should have efficient risk management framework to mitigate all internal and external risks. The objective of this study is to envisage ideal framework of bank-wide risk management for Indian Banks. The presence of accurate measures of bank-wide risk management practice increase shareholder’s returns and allows the risk-taking behavior of bank to be more closely aligned with strategic objectives. Bank-wide risk management practice should aim to enhance the drivers of shareholder’s value such as: – 0 Growth; 1 Risk adjusted performance measurement; 2 Consistency of earnings; and 3 Quality and transparency of management. The important steps of the efficient framework of banking concern should ensure all risks are identified, prioritized, quantified, controlled and managed in order to achieve an optimal risk-reward profile. This entails ideal and dedicated coordination of risk management across the bank’s various business units. However, the approach to monitoring and enforcing the adherence of business units within the bank may vary. The factors that influence this decision are: – 4 The feasibility decisions of the business unit. Â  5 The regulatory requirements in respect of the business unit. 6 The cost of effective monitoring and controlling steps. Risk management is a line function that needs to be addressed by each individual cost center and business unit. However, a centralized bank-wide risk management framework has certain advantages for the Bank. The advantages are: – 7 Improving capital efficiency by providing an objective basis for allocating resources reducing expenditures on immaterial risks and exploring natural hedges and portfolio effects; 8 Supporting informed decision making by uncovering areas of high potential adverse impact on drivers of share value, and identifying and exploiting areas of risk-based advantage context. 9 Building investor confidence by establishing a process to stabilize results by protecting them from disturbances, and demonstrating proactive risk stewardship 10 Define cost and profitability centers 11 Profitability and cost allocation on customer, product, services and branch wide Most of the banks do not have dedicated risk management team, policy, procedures and framework in place. Those banks have risk management department, the risk manager’s role is restricted to pre-fact and post-fact analysis of customer’s credit and there is no segregation of credit, market, operational and strategic risks. There are few banks have articulated framework and risk quantification. However, the outputs are far from the stressed or actual losses due to usage of un-compatible implications. The traditional lending practices, assessment of credits, handling of market risks *, treasury functionality and culture of risk-rewards are hauls of public sector banks. Where as private sector banks and financial institutions are some-what better in this context. The sheer size and wide coverage of banks is a big hurdle to integrate and generate a cost effective real time operational data for mapping the risks. Most of the financial institutions processes are encircled to ‘functional silos’ follows bureaucratic structure and yet to come up with a transparent and appropriate corporate governance structure to achieve the stated strategic objectives. CONCLUSION There are many banks like HSBC, Citibank, Deutsche bank have bank-wide risk management practice which contributed in their global success whereas banks and institutions like Sumitomo Corp, Barings, Bank of America, CSFB and UTI have failed due to lack of efficient bank-wide risk management practice (compliance and operational risks). So the above comments emphasis the necessity of having bank-wide risk management to achieve the stated strategic objectives in a competitive, volatile and dynamic market conditions in an emerging Indian economy. Offer had be defined in S2(a) Contracts Act 1950 as â€Å"when one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to the act or abstinence, he is said to make a proposal†. Under the Contract Act 1950, a proposal is something which is capable of being converted into an agreement by its acceptance.Moreover, merely giving information is not an offer. For example of Harvey v Facey (1893) case, P telegraphed D – â€Å"Will you sell us Bumber Hall Pen? Telegraph lowest cash price. † D replied, â€Å"Lowest cash price ? 900. † P purported to accept the offer. The court held that price information is merely information. There was no offer to accept. Khalil had given clear information that he want to buy Siti’s painting with the price RM 5, 000, the offer is exist. But Siti said she will think about it. Two weeks after she made her mind that she want to sell the painting to Khalid for RM7,000 not Rm 5,000.This is a counter offer not acceptance. Counter offer had be defined in S6(c) Contracts Act 1950 as â€Å"by the failure of the acceptor to fulfill a condition precedent to acceptance. † Siti as the offeree makes a count offer revokes the original offer which made by Khalil. Counter offer had also defined in S7(a) Contracts Act 1950 in order to convert a proposal into a promise that acceptance it must â€Å"be absolute and unqualified†. It does refer to the case of Hyde v Wrench (1840), D made an offer to sell his house for ? 1000.P purposely accepted at ? 950 but D refused, P accepted the original offer of ? 1000. The court held that counter offer terminated the original offer. There was nothing to accept. Furthermore, acceptance had be define in S2(b) Contracts Act 1950 as â€Å"when the person to whom the proposal is made signifies his assent thereto, the proposal is said to be accepted: a proposal, when accepted, becomes a promise†. Thus the original offerror whose offer has been terminated by the offeree’s counter offer can accept or reject the offeree’s counter offer.Khalid said that the price Siti offered was too high and he did not want the painting, means that this is a rejection by Khalid. One week later, Khalid received bonus from his employer. After he got the money to pay so and he immediately contact Siti that he will pay the RM7,000 for â€Å"Hawa†. This is a new counter offer from Khalid. According to S2(a) Contracts Act 1950 â€Å"when one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to the act or abstinence , he is said to make a proposal†.But Siti has refused to sell the painting to Khalid with the price RM7, 000; she then said that for the price of her painting has gone up to RM10, 000. This is can counter offer. Conclusion There is no valid contract between Khalil and Siti. The moment that Siti sell her panting for RM 7,000, Khalil had refuse and reject the offer. When he wanted to buy the painting with RM 7, 000, Siti had gone up the price of her painting as RM 10, 000. For the whole â€Å"trade† there is no acceptance exists. There is just exist offer, couter offer and revocation. A contact without acceptance is void, therefor; there is no contract between them.

IKEAs reputation is a key point for its recruitment process; as said by their Recruitment and Competencies Development Manager when we interviewed her: Applications are usually spontaneous. They either come through our website or applicants bring their CVs directly to the store. But sometimes they come in response to an offer. In most cases, companies need to seek out their prospective employees.In this case, applicants tend to apply they wish to work for the company. This, linked to the fact that IKEAs turnover is very low can give us an overview of how successful IKEAs recruitment process is. 2 3. Recruitment policies and methods Recruitment at IKEA did not seem to be an issue. The HR Department of IKEA receives about 7 CVs every day, and 200 every month, most of them sent by e-mail through the IKEA recruitment web page, which clearly facilitated the process for applicants. In addition,external channels such as Pà ´le Emploi and local partnerships with associations and schools are also used at times. For instance, IKEA is starting to develop partnerships with Business and Communication schools in the area of Lille. IKEAs policy is to build a long-term relationship with its employees and help them develop themselves both on the professional but also personal level.   Therefore, one of the aspects of recruitment at IKEA is that they tend to privilege internal recruitment when a position is available. However when there is no potential within the body of employees, the Recruitment Officer that we met said that she has to go and search the candidates elsewhere, and this is where external recruitment comes in. Many directors nowadays started their career with part-time jobs at IKEA when they were still students and managed to climb up the companys ladder thanks internal recruitment. We were told that there is a floor manager for every department (kitchen, bathroom, living room, etc.), and when they feel like they could use one more salesperson in his department, they report their needs to the HR Manager who takes care of the recruitment and selection. With time and experience, the job analysis and information gathering are not necessary anymore, because the HR managers know exactly what type of people the floor managers want, especially for shop-floor workers. For managers, the question is trickier: when internal promotion is possible, the problems dont arise, candidates usually fit the job description, but when there is a need to go through external channels, the specifications and necessary competencies are stated very clearly, although IKEA employees do not have a typical profile. There is no feedback for the negative answers by mail (step 4) but the candidates can ask for a feedback. The process for a position with responsibilities it longer and more difficult. For a manager position the decision of the HR manager is followed by 4 others interview whereas for a shop floor position there is only 2 interviews after the HR managers decision. This decision can only be achieved with a consensus and it is very important that no doubt whatsoever are remaining when selecting a candidate. As the decision process involves several people, it is supposed to be a guarantee that the candidate who is selected is a good fit for the company. In addition, this plurality of point of views are also necessary to ensure the fairness of the selection process. III. Beyond recruitment and selection 1. Fairness and Ethics When we met the Recruitment Officer at IKEA, she told us that she and the other interviewers were all experienced and intended to be as fair as possible, asking open-ended questions and reformulating so that they do not misunderstand what the candidates say. The selection methods used are diverse and the exchanges are multiple, which improves the fairness of the process.    However, she repeated that Human Resources remain Human Sciences, and are not accurate every time. 2.
